1、成功的法律保障之一—遵循Mines and Minerals Act
所涉及的具体法律规定:
1)Subject to the provisions of this Act, the right to prospect for, to retain and to mine, minerals may be acquired and held only under and in accordance with the provisions of this Act, notwithstanding any right of ownership or otherwise which any person may possess in and to the soil on, in or under which minerals are found or situate.
根据本法的规定,探矿权、保留矿权和采矿权只能依据并按照本法的条款获取和持有,尽管任何人可能对发现或位于矿物所在的土地表层、地下或土壤拥有所有权或其他权利。
2)No person may prospect for or mine minerals except as provided in this Act.

3)No mining licence or any interest therein shall be transferred, assigned, encumbered or dealt with in any other way without the approval of the Minister.

4)Subject to this section, a prospecting licence or any interest therein or any controlling interest in the holder thereof may be transferred any other person provided that the Minister is notified not less than 30 days before the intended transfer.

5)No retention licence or any interest therein shall be transferred, assigned, encumbered or dealt with in any other way without the approval of the Minister.

6)Where in this Act provision is made for a matter to be referred to arbitration, the matter shall be referred to a single arbitrator appointed by the parties and finally resolved under the rules of the International Centre for the Settlement of Investment Disputes in force from time to time or in accordance with such other rules or procedures as the parties may agree.
根据本法的规定,凡涉及需提交仲裁的事项,应由双方共同任命一名仲裁员,按照当时有效的《国际投资争端解决中心规则》或双方商定的其他规则或程序进行最终裁决。
2、成功的法律保障之二—遵循Environmental Assessment Act
所涉及的具体法律规定:
1)No person shall undertake or implement an activity prescribed under section 3 unless — (a) such person has applied to a licensing authority for authorization to undertake such activity and authorization has been issued under section 12; and (b) the environmental impact of the proposed activity is fully taken into account in accordance with the provisions of this Act.
任何人不得实施或执行第3条规定的活动,除非——(a) 该人已向许可机关申请授权开展此类活动,并根据第12条获得授权;且 (b) 拟议活动的环境影响已根据本法的规定得到充分考虑。
2)Where the competent authority determines that the proposed activity is likely to have a significant adverse environmental impact, it shall require that such activity undergo an environmental impact assessment or a strategic environmental assessment, the costs of which shall be borne by the developer.
如果主管部门认定拟议的活动可能对环境产生重大不利影响,则应要求该活动进行环境影响评估或战略环境评估,评估的费用由开发商承担。
3)An environmental impact assessment shall identify and evaluate the environmental impact of an activity with particular reference to the — (a) health, safety or quality of life of people; (b) archaeological, aesthetic, cultural or sanitary conditions of the environment; and (c) configuration, quality and diversity of natural resources.
环境影响评估应特别关注以下方面,识别和评估一项活动对环境的影响:
(a) 人们的健康、安全或生活质量;

4)An applicant shall before undertaking or implementing an activity engage a practitioner to do a scoping exercise (2) The applicant shall during a scoping exercise — (a) publicise once the intended activity, its effects and benefits in the mass media using the official languages for a period of not less than 21 days; and (b) after the expiration of the period of 21 days, ensure that the practitioner referred to under subsection (1) holds meetings with the affected people or communities to explain the nature of the activity and its effects.
申请人在开展或实施活动之前,应聘请一名从业者进行初步调查。申请人在初步调查期间应:(a) 使用官方语言通过大众媒体对拟开展的活动、其影响和益处进行至少21天的公告宣传;以及(b) 在21天公告期满后,确保第(1)款中提到的从业者与受影响的人群或社区召开会议,解释该活动的性质及其影响。
5)The developer shall submit an evaluation report to the relevant technical department or local authority, at such times as the department or local authority shall determine.
